P.S. For the record, I think that the FIA were somewhat wrong in bringing
this action - I believe, but I can't be bothered to check too carefully,
that Max (or the FIA) have said in the past that if the scrutinisers say
it's okay, then it's okay, and vice versa (e.g. the differential braking
system used by McLaren in 1998)

But they then banned it!

I think there are other cases of the same thing, where a team believed they
were legal, and then were scrutinised as being so, but later the FIA decided
that it was not the case. IIRC

Just heard Nick Fry say that the team will go to the civil courts to
try to get an injunction allowing them to qualify and race.

Good for BAR!

Taking sporting decisions to civil courts is an incredibly bad
idea. It ought to be part of the regs that any team that takes
a case to a court outside of the actual sport's ruling authority
will not be allowed to participate in any season thereafter.

The car was legal, it just didn't have enough *proper* ballast in it. The
FIA did not say to them they could use fuel as a ballast, nor did they say
they could fail the weigh-in after the race if it was 'OK' with fuel in it.

Ridiculous..
