Conviction of man who slammed on brakes upheld

John F. Carr 26 February 2005 23:07:24

On usenet one reads a lot of assertions that a rear end collision is
always the fault of the rear driver. Here is the Vermont Supreme
Court's decision in a case where the guy who slammed on his brakes
was convicted of grossly negligent driving:

<http://dol.state.vt.us/gopher_root3/supct/current/2003-329.eo>

Paragraphs 2-6 summarize the facts of the case: the defendant was
driving 15 MPH under the speed limit and apparently took offense
when a motorcycle wanted to pass.

A spam script cannot perjure itself. Mental competence is prerequisite for
perjury and a computer script does not possess such competence.

Hey dood. We got a president who lied us into a war against a
defenseless nation so don't preach to me about honesty.

Hell, even Eliza, as archaic as it is, produced more intelligent
dialogs than the script LBMHBF does.

Actually, someone needs to "teach" you about honesty, since you
obviously don't know what it is.

By the way, Bush didn't lie us into war, no matter how much you'd like
to believe he did.

And thank God we've got such a nice lady like Laura Bush for first
lady. Beats the hell out of that sack of crap the DNC offered up last
year.

You have to admit, it would have been fun to watch the comedians beat
up on Teresa Heinz [Kerry] for 4 years...

BTW, did you notice she dropped the "Kerry" from her moniker now that
the election is over!?

Harley riders also tend to ride a lot slower than the ricers, too.
That observation based on the fact that I tend to drive between the
two speeds, as most Harleys I see I'm looking at in the rear view, and
most ricers I'm looking at through the windshield. Regardless of which
side of the car they are on, the distance between them and I is
increasing sans obstructions. :-)

My great grandfather drove a Harley motorcycle. This was way before they
even had helmets, but he wore goggles and a leather cap. He also had a
sidecar, something you don't really see now days. My grandfather wasn't
really the "biker" type in the sense that he was good natured and had
nothing to prove to anybody. I think he drove a bike because during the
depression it was a cheap way to get around.

My uncle, OTOH, does have a motorcycle, but he rarely drives it now days.
OTOH, he was more what people think of as a "biker". He had a few spills in
his time was definitely into doing some dangerous stuff. I don't remember
if he ever wore a helmet; I doubt it. My aunt married him and he changed
alot over the years.

Gee, sounds just like a biker we all know, don't we Brent?

Is there such a charge as "operating a firearm in a grossly negligent>manner with serious injury resulting"?

Pointing a gun at somebody to scare him is assault with a deadly weapon.
A reckless act causing bodily harm is assault and battery.
A reckless act causing death is manslaughter (not murder).

The precise names of the crimes depend on the state. For example,
"assault with a deadly weapon" could be "aggravated assault" and
"manslaughter" could be "fourth degree homicide."
