What should I have done here?

Robert F Merrill 26 January 2005 11:56:18
First let me describe the intersection of Main and Newtown in East Hampton,
NY:

Newtown and Main intersect in a "T" with a short median at the end of
newtown. Newtown has two lanes heading towards main, but only 1 heading
away from it. Main street has both dedicated left and right turn lanes onto
main street.

A few weeks ago I was driving to school in my mom's car. I approached the
intersection on main street, about to make a RIGHT turn onto newtown. On
the other side of an intersection is a dump truck (or garbage truck, don't
remember) in the LEFT turn lane (going in the same direction as me) --
behind the line, not actually in the intersection.

The light is yellow, so I decide for safety's sake (I don't know how long
the yellow period is) that I'll come to a complete stop before making my
right turn.

I make my complete stop, and then proceed to start turning. However, at
about the same time, the truck (in the left turn lane opposite me, still
behind the line) enters the intersection. I start to brake, but realizing
I'm in his way already I go back on the gas. He stops when he realizes that
I'm going, quite a good distance away from me.

My mom was frantically screaming at me, despite the fact that there was
barely any risk of an accident at all.

Here's why I think I was right to go first:

- I was making a right turn, he was making a left, so I have the right of
way in most situations.
- He was turning left against either a red or a yellow about to run out.
- He was behind the line, and not already in the intersection.

Was there anything I did wrong?

If the truck was stopped had not entered the intersection prior to the
light turning yellow, he should _not_ have entered it once it did turn
yellow. If he intended to complete his left turn as the light changed,
he should have pulled halfway into the intersection while the light was
green and waited there for the oncoming traffic to clear. That way his
intent would be obvious. Waiting outside the intersection means he's
going to wait for the next green or left turn arrow.

You contributed to the confusion by stopping during your right turn on
yellow. If you would have continued your turn without hesitation, the
truck probably would have sequenced in behind you with no issues.

So, as in many of these situations, noone really did anything wrong
(illegal), but you both faked each other out by not doing what the
other expected.

There is no law against entering an intersection on yellow.

Ones that say you shouldn't enter on yellow unless it is unsafe to stop? If
the truck is stopped, then he shouldn't start moving on yellow, unless he's
already in the intersection, which he wasn't.

I would have waited for him except he was at a complete stop behind the
line, and not actually in the intersection. From what I've been told, if
you're waiting to make a left and you're blocked off by oncoming traffic,
you should go past the line and wait IN the intersection, however maybe
this isn't safe for a big truck.

You are an inexperienced driver. You have been told by many
experienced drivers that what you did was unsafe because it confused
the truck driver. Take that for what it's worth, and don't grasp for
justifications.

If you stop, make sure no other vehicles (or pedestrians, see Mr.
Galt's excellent comment) have taken your stop as an indication that
it is safe for them to proceed before you proceed.
